The National Co-operative Credit Union (NCCU) has issued a public notice of judgment requiring a debtor, Kervin Toussaint, to appear before the court, in a step taken to enforce an outstanding debt owed to the institution.
The notice, published as a general announcement, is a re-summon for the debtor to appear. The NCCU did not disclose the amount of the debt or the circumstances under which it arose, and the notice did not state a hearing date or the court before which Mr Toussaint is required to appear.
The publication of such notices is a standard legal procedure available to the NCCU and other co-operative credit unions in Dominica when a member has fallen into arrears and the institution has obtained a judgment. Once a judgment is entered, the credit union may apply to the court for an order requiring the debtor to appear to be examined on their means, or to show cause why the judgment should not be enforced. Failure to comply with such an order can lead to further enforcement action.
The NCCU is one of the largest co-operative financial institutions in the Commonwealth of Dominica, with a membership drawn from across the island and the diaspora. Like other credit unions, it is owned by its members and regulated under the co-operative framework. Its lending operations are funded largely by members' savings and deposits, which is why recovery of delinquent loans is treated as a matter of protecting the collective interest of the membership.
Notices of this kind are published in the public interest so that the person named can be located and given the opportunity to respond. They are not criminal proceedings, and the publication of a notice does not imply any finding of wrongdoing beyond the judgment debt itself. Debtors named in such notices retain the right to seek legal advice, to negotiate repayment terms with the credit union, or to apply to the court for relief.
Members of the public who believe they may be affected by similar proceedings are advised to contact the NCCU directly or consult an attorney. The credit union has not indicated whether any further steps will follow if Mr Toussaint does not appear as required.
